Concern on Commission warning powers draft guidance

The Charity Commission (for England and Wales) has opened a public consultation on its proposed approach to exercising new powers to issue an official warning to charities when it considers that there has been a breach of trust or duty, or other misconduct or mismanagement in the charity.

Civil Society News reports that the draft guidance has caused concern with sector bodies such as NCVO and Charity Finance Group about safeguards and clarity on the use of warning notices, and a leading sector lawyer branded it “misleading in a number of respects” and lacking a “number of the key assurances given by the minister for civil society” during the legislative debate.
