New charity guidance on public benefit and purposes

The Charity Commission has published revised public benefit guidance for all charities in England and Wales, after the Charity Tribunal considered the case put by independent schools. See Commission news item

Three short guides are available in online and pdf versions – the public benefit requirement (PB1), running a charity (PB2) and reporting (PB3). Trustees must have regard to this guidance when administering their charity, and there are also an overview and a summary.

The Commission also published new guidance on charitable purposes ‘What Makes a Charity‘ (CC4). Lawyer Rosamund McCarthy told Third Sector magazine that she was concerned that Annex B, which describes when an organisation is being political, contains much tighter rules than CC9, the commission’s existing guidance on campaigning,
