The Scottish charity regulator OSCR has published ‘Guidance for charity trustees on the referendum on independence for Scotland’ and unlike its earlier draft version this has been welcomed by sector body SCVO, whose chief executive said “Charities play a huge role in public life in Scotland so the referendum is bound to have a big impact on them. Decision making for charity trustees

The Charity Commission for England and Wales has issued a final version of its guidance on decision making for charity trustees – a draft was circulated for comment earlier this year. ‘Its Your Decision’ explains the key principles of decision making that the courts and the Commission expect trustees to apply when they are making significant or strategic decisions about their charity.

Cy-près variations of charitable trust in NI

New on the Charity Commission for Northern Ireland’s website is guidance on Cy-près schemes, which are legal documents allowing the Commission to amend the terms of a charitable trust, where the original intention of the donor can no longer be carried out.

While CCNI is now accepting requests for such schemes, they cannot finalise one until a further CCNI statutory provision is made, hopefully by late 2013.
